Disclaimers, Limitation of Liability, and Indemnity
The Site and all content are provided on an “as is” and “as available” basis without warranties or conditions of any kind, whether express, implied, or statutory, including without limitation implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, or that the Site will be uninterrupted, error-free, current, complete, or accurate. To the maximum extent permitted by applicable law, in no event will we or our affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for any loss of profits, revenue, savings, data, or goodwill; or for business interruption, arising out of or in connection with your use of or inability to use the Site, even if advised of the possibility of such damages. To the extent any liability is not lawfully excludable, our total aggregate liability to you for all claims arising out of or relating to the Site or these Terms will not exceed the greater of (a) one hundred Canadian dollars (CAD $100) and (b) the amounts you paid to us (if any) for access to the Site in the twelve months preceding the claim. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous understandings. We may assign these Terms without notice; you may not assign them without our prior written consent. Headings are for convenience only.
